By accessing or using Promt Cafe's services, including our website, mobile applications, AI Sommelier system, and restaurant facilities (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our Services after changes are posted constitutes your acceptance of the modified Terms.

2. Eligibility

You must be at least 18 years old to make reservations or use our Services independently. Minors may visit our restaurant when accompanied by a parent or legal guardian who accepts responsibility for their compliance with these Terms.

By using our Services, you represent and warrant that you have the legal capacity to enter into this agreement.

3. Reservations and Cancellations

3.1 Making Reservations

Reservations can be made through our website, mobile app, phone, or authorized third-party platforms. All reservations are subject to availability and confirmation by Promt Cafe.

3.2 Reservation Requirements

• You must provide accurate contact information when making a reservation
• You must specify any dietary restrictions, allergies, or special requirements at the time of booking
• Large party reservations (6 or more guests) may require a deposit or credit card guarantee

3.3 Cancellation Policy

• Cancellations must be made at least 24 hours before your reservation time
• Late cancellations (less than 24 hours) may result in a cancellation fee of $50 per person
• No-shows will be charged the full cancellation fee
• For special events or private dining, different cancellation policies may apply

3.4 Modifications

Changes to your reservation (date, time, party size) should be made at least 12 hours in advance and are subject to availability.

4. AI Sommelier and Personalized Menus

4.1 How It Works

Our AI Sommelier system creates personalized menu recommendations based on information you provide about your dietary preferences, restrictions, allergies, flavor preferences, and dining goals. The system uses machine learning algorithms to optimize your culinary experience.

4.2 Accuracy of Information

IMPORTANT: The accuracy and safety of your personalized menu depend on the information you provide. You must:

• Accurately disclose all food allergies and dietary restrictions
• Update your profile if your dietary needs change
• Inform your server of any allergies or restrictions before ordering

4.3 No Medical Advice

While we make every effort to accommodate dietary restrictions and allergies, we cannot guarantee that our kitchen is completely free from allergens. Cross-contamination may occur. If you have severe allergies, please inform your server and discuss your needs in detail.

5. Payment Terms

5.1 Accepted Payment Methods

We accept major credit cards, debit cards, and other payment methods as displayed at our restaurant. Payment is due at the time of service.

5.2 Pricing

• Prices are subject to change without notice
• Personalized menu pricing varies based on ingredients and complexity
• All prices are in US dollars unless otherwise stated
• Gratuity is not included in menu prices and is at your discretion

5.3 Service Charges

For parties of 6 or more, an automatic service charge of 20% may be added to your bill. Special events and private dining may have additional service charges.

6. Conduct and Restaurant Policies

• Treat staff, other guests, and property with respect
• Follow our dress code (smart casual)
• Refrain from disruptive behavior
• Comply with health and safety regulations

6.2 Right to Refuse Service

We reserve the right to refuse service or remove guests who:

• Engage in inappropriate, offensive, or disruptive behavior
• Appear intoxicated or under the influence of substances
• Violate these Terms or restaurant policies
• Pose a safety risk to staff or other guests

6.3 Photography and Recording

Personal photography for non-commercial purposes is permitted. However, professional photography, videography, or recording for commercial use requires prior written permission. By dining with us, you consent to potentially appearing in photographs or videos taken by Promt Cafe for marketing purposes.

7. Intellectual Property

All content on our website, including text, graphics, logos, images, software, and AI algorithms, is the property of Promt Cafe and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, reproduce, or distribute our content without permission
• Reverse engineer or attempt to extract our AI algorithms
• Use our trademarks or branding without authorization
• Create derivative works based on our Services

8. User Accounts

8.1 Account Creation

You may create an account to access enhanced features, save preferences, and manage reservations. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

8.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activity.

9. Data Collection and Privacy

10. Limitation of Liability

You agree to indemnify, defend, and hold harmless Promt Cafe and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any rights of third parties
• Your use or misuse of our Services
• Any inaccurate information you provide regarding allergies or dietary restrictions

12. Warranty Disclaimer

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

While we strive to provide accurate personalized recommendations, we do not warrant that:

• Our Services will meet all your expectations
• The AI Sommelier will always provide perfect recommendations
• Our Services will be uninterrupted, timely, secure, or error-free
• All allergens can be completely avoided in our kitchen

13. Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, labor disputes, or technical failures.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our primary location is situated, without regard to conflict of law provisions.

14.2 Arbitration

Any dispute arising from these Terms or our Services shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify. The arbitration shall be conducted by a single arbitrator in accordance with applicable arbitration rules.

14.3 Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class, consolidated, or representative action.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Promt Cafe regarding your use of our Services and supersede all prior agreements and understandings.
